4. Governing Law and Jurisdiction

The sales contract is deemed to have been entered into in Italy and is governed by Italian law, without prejudice to the mandatory consumer protection statutory provisions in force in the European Union country where the Consumer has habitual residence. For any civil dispute between Aeternus S.r.l. and a consumer Customer, mandatory territorial jurisdiction belongs exclusively to the courts of the place of residence or domicile of the Consumer. For Customers not qualifying as Consumers (companies, commercial professionals acting under a VAT number) or for Customers residing outside the European Union, the Court of Bergamo (Italy) shall have exclusive jurisdiction.
